d. ALTA 41.3-06 (Water – Land Under Development): Provides the same coverage
and includes the same definition of “Improvements” as the ALTA 41.1-06.
However, it expands the coverage to include “future improvements” as depicted
on “plans” of a designated architect or engineer bearing a certain date,
identifying a specific project name or number and containing a designated
number of pages. This is the only endorsement in the series which may be used
with vacant land being developed, or with existing improved land when future
improvements are anticipated.

III. Title Tips:

a. In most circumstances, an ALTA/NSPS survey will be required to determine
coverage.

b. A review of the plans identifying the location of future improvements may be
required to provide coverage under ALTA 41.3-06 (Water – Land Under
Development).

c. All endorsements in the ALTA 41 series provide a blank in Section 4.c. in order to
identify any right or interest excepted in the Policy to be excluded from coverage
under the endorsement.

d. The ALTA 41 series endorsements are primarily issued in western states.
