ALTA 23.1

Co-Insurance – Multiple Policies

The ALTA 23.1 is intended for those situations in which co-insurance is requested in connection with
the issuance of several policies of title insurance under which liability is being aggregated using an
ALTA 12 endorsement or ALTA 12.1 endorsement. The endorsement states that if the lead or issuing

co-insurer’s policy is aggregated with other policies the lead insurer is issuing, a co-insurer’s policy
is also aggregated with that of the lead insurer, but only if the co-insurer issues its own aggregation

endorsement. Each aggregating co-insurer remains liable only for its stated Percentage of Liability of
any total loss as sustained under the aggregated policies, but in no event for any amount larger than
its Aggregate Amount of Insurance as set forth in that Co-Insurer’s aggregation endorsement. This

endorsement is available for owner’s and loan policies.
