        ALTA 8.1

        Environmental Protection Lien



        The ALTA 8.1 insures a lender of a residential loan against loss of priority due to (i) a federal or state
        environmental protection lien filed in the public records or the U.S. District Court for the district in
        which the land is located at the Date of Policy, and (ii) an environmental lien provided for by a state

        statute (super lien) in effect on the Date of Policy, but excepting those statutes listed in Section (b)
        of the endorsement. Both Fannie Mae and Freddie Mac require a statement that no environmental

        protection liens have been recorded on loans they purchase from institutional mortgage lenders.
        Because lenders are uncertain which loans might be owned by Fannie Mae or Freddie Mac, most
        lenders require the endorsement as a matter of course. This endorsement is available on residential

        loan policies only.
