ALTA 30.1

Commercial Participation Interest

The ALTA 30.1 is similar to the ALTA 30, in that it provides coverage for loss or damage if the Insured
Mortgage is deemed invalid or unenforceable, or if the priority of the Insured Mortgage is lost or
affected by shared equity or shared appreciation provisions contained in the documents evidencing

and securing the Indebtedness secured by the Insured Mortgage. This endorsement also provides
coverage against loss or damage due to invalidity, unenforceability, or lack of priority of the Insured

Mortgage arising out of provisions in the Loan Documents that provide the lender with participation
in the property’s cash flow. This endorsement is only available for loan policies.
