Minerals and Other Subsurface Substances – Land Under Development

This ALTA 35.3 gives coverage that is prospective in nature. The ALTA 35.3 indemnifies an Insured as
to loss or damage as a result of the enforced removal or alteration of any Improvements or Future
Improvements, arising from the exercise of a right existing on Date of Policy, to use the surface

of the Land for the extraction or development of minerals or any other subsurface substances. It
specifically excludes contamination, explosion, fire, vibration, fracturing, earthquake, subsidence or

negligence by the extracting party. This endorsement is available for both owner’s and loan policies.
