Energy Project - Leasehold/Easement - Owner’s

The ALTA 36 is for issuance with an Owner’s Policy that insures an easement or an easement and a
lease in an energy project. It is a variation of the ALTA 13 leasehold series endorsements. The term
“Electricity Facility” describes an existing electricity generating facility and one under construction

or to be built according to Plans for the project. The definition of “Severable Improvement”, is similar
to the same definition appearing in the ALTA 31. The endorsement also contains a definition for

“Constituent Parcel” meaning “one of the parcels of Land described in Schedule A that constitute an
integrated project.” It excludes from coverage loss, cost or damage related to remediation resulting
from environmental damage or contamination. This endorsement is available for owner’s policies

only.
