ZONING ENDORSEMENT SERIES
ALTA ENDORSEMENTS 3, 3.1, 3.2, 3.3, 3.4
I. Purpose:
The ALTA 3 series of endorsements provides assurances that the land described in the
policy is zoned in a specific classification and that one or more listed uses are
permitted in that classification.
The ALTA 3 series of endorsements may be issued with both an owner’s and loan
policy.
II. Coverage Provided:
a. ALTA 3 (Zoning): Provides insurance against loss or damage sustained due to the
failure of the insured land to hold a particular zoning classification. It also provides
insurance if certain specified uses are not permitted under the identified zoning
classification.
b. ALTA 3.1 (Zoning – Completed Structure): Provides the same insurance coverage as
the ALTA 3-06, and also provides coverage against the forced removal or alteration
of existing structures due to a zoning violation with respect to the following
matters: (i) building site dimension (area, width, or depth), (ii) floor space, (iii)
setback, (iv) height, and (v) number of parking spaces.
c. ALTA 3.2 (Zoning – Land Under Development): Provides the same insurance
coverage as the ALTA 3.1-06 and also provides coverage for forced removal or
alteration of improvements that are constructed on the land as part of an ongoing
or contemplated construction project in accordance with identified plans and
specifications that depict the contemplated improvements.
d. ALTA 3.3 (Zoning – Completed Improvement – Legal Non-Conforming Use): Insures
against loss or damage if a specified non-conforming use or non-conforming
improvement as defined therein is not permitted because it violates an existing
county or municipal zoning ordinance. The endorsement also insures against the
forced removal or alteration of an existing building because the non-conforming
use or non-conforming improvement does not comply with the existing county or
municipal zoning ordinance regarding the following matters: (i) building site
dimension (area, width, or depth), (ii) floor space, (iii) setback, (iv) height, and
(v) number of parking spaces.
