e. ALTA 3.4 (Zoning – No Zoning Classification): Issued on land improved with an
existing building or structure where there is no zoning ordinance or zoning
classification. The endorsement insures against loss or damage if the specific use
designated in the endorsement is not allowed because it violates a county or
municipal zoning ordinance. The endorsement further insures against loss or
damage due to forced removal or alteration of an existing building or structure
because it violates a county or municipal zoning ordinance regarding the
following matters: (i) building site dimension (area, width, or depth), (ii) floor
space, (iii) setback, (iv) height, and (v) number of parking spaces.
III. Title Tips:
a. In most circumstances, an ALTA/NSPS survey, zoning report or zoning
compliance letter from the appropriate jurisdiction will be required to provide
the coverage.
b. For the issuance of an ALTA 3.2, a zoning compliance letter, plans with a survey
overlay of land, and specifications of the contemplated construction project will
be required.
c. For policies for which an ALTA 3.2 is issued for land under development, if the
Insured requests the issuance of the ALTA 3.1 post-construction, an As-Built
Survey and certification from appropriate authorities will be required to confirm
that the project was constructed in accordance with the plans and specifications
identified in the ALTA 3.2.
