e. ALTA 3.4 (Zoning – No Zoning Classification): Insures against loss or damage
if a specified use is not allowed because it violates a municipal or county zoning
ordinance or zoning regulation. In addition, this endorsement insures against a
final court order either prohibiting the present use or requiring removal or
alteration of the existing building or structure because the use violates a zoning
ordinance or zoning regulation as to: (i) area, width or depth of the land as a
building site for the structure, (ii) floor space area of the structure, (iii) setback of
the structure, (iv) height of the structure, or (v) number of parking spaces.
III. Considerations:
a. In most circumstances, a survey, zoning report or zoning letter from the
appropriate jurisdiction will be required to provide the coverage.
b. For the issuance of an ALTA 3.2, plans and specifications of the contemplated
construction project will be required.
c. For policies for which an ALTA 3.2 is issued for land under development, if the
Insured requests the issuance of the ALTA 3.1 post-construction, an As-Built
Survey and certification from appropriate authorities will be required to confirm
that the project was constructed in accordance with the plans and specifications
provided to issue the ALTA 3.2 with the policy at closing.
