ALTA 36.9

Energy Project - Minerals and Other Subsurface Substances - Land Under Development

The ALTA 36.9 provides the Insured with coverage against loss or damage due to the removal or
alterations of an existing Electric Facility or a Severable Improvement existing as of the Policy
Date or to be built according to identified plans arising out of the future use of the surface of the

land to extract subsurface substances, including minerals that either are excepted in Schedule B
or an exception on the land described in Schedule A. This endorsement is available for owner’s

and loan policies.
