ALTA 49.1
Forgery - Existing Owner’s Policy-Residential
The ALTA 49.1 is designed to be issued when the residential homeowner has previously purchased an
ALTA Owner’s Policy and would like the existing policy to be modified to include coverage for defects
in title caused by a post-policy forgery of a deed or mortgage recorded in the public records. For
example, if an owner is refinancing a loan and they already have an owner’s policy, this endorsement
can be offered to the insured owner unless prohibited by state regulations.
Unlike the ALTA 49, the ALTA 49.1 includes “Date of Endorsement” as a defined term to be completed
when the endorsement is issued. A title search must be conducted from the date of policy forward
and examined for post-policy forgery of a deed or a mortgage recorded after the policy date. The
Date of the Endorsement is the date through which the public records have been searched. The
endorsement also modifies policy exclusion 3.b. to exclude from coverage matters not known to the
title company but known to the Insured and not disclosed in writing to the Company prior to the Date
of Endorsement.
