ALTA 3.3
Zoning - Completed Improvement - Non-Conforming Use
The ALTA 3.3 is used on land improved with an existing building or structure. It is issued when a
specified use or improvement is allowed to continue on the land even if it is not in compliance
with the local zoning ordinance because the use or improvement existed before the change in the
zoning ordinance. The ALTA 3.3 insures against loss or damage if a specified use or non-conforming
improvement as defined therein is not permitted because it violates the local zoning ordinance. The
endorsement also insures against the forced removal or alteration of an existing building because
the non-conforming use or non-conforming improvement does not comply with the local zoning
ordinance regarding the following matters set forth in section 2.c. of the endorsement which can be
selected by checking the applicable box:
☐ The area, width, or depth of the Land as a building site for the Improvement;
☐ The floor space area of the Improvement;
☐ A setback of the Improvement from the property lines of the Land;
☐ The height of the Improvement; or
☐ The number of parking spaces.
The endorsement does not cover any change, cessation, abandonment or replacement of the non-
conforming use or improvement, a prohibition to restore the improvement, lack of compliance
with any law regarding the continuation of the non-conforming use or improvement and any law
requiring the amortization, expiration or, elimination by passage of time of the non-conforming use.
This endorsement is available for owner’s and loan policies.
