        ALTA 28.3-06

        Encroachments - Boundaries and Easements - Land Under Development



        The ALTA 28.3 is intended for use in those instances in which we are provided plans and drawings
        clearly depicting improvements to be constructed on the land in the future. The endorsement adds
        two additional definitions not included in the ALTA 28.2 endorsement. The definition of “Future

        Improvement” is expanded to include a building area, structure, or paved area to be constructed on
        the Land after the Date of Policy. “Plans” are defined as: a survey, site and elevation plans or other

        depictions or drawings prepared by a named architect or engineer as of a particular date bearing
        a described project name or number and consisting of a defined number of pages. The substantive
        coverage in the endorsement is identical to that in the ALTA 28.2 endorsement with respect to

        existing improvements. The ALTA 28.3 expands coverage to future improvements to be constructed
        according to the plans and specifications provided. This endorsement is available for owner’s and

        loan policies.
